MaxVault Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Rambax, LLC (“Rambax,” “we,” “us,” or “our”) governing MaxVault. By downloading, purchasing, accessing, or using MaxVault, you agree to these Terms.

1. Eligibility and Authority

You must have the legal capacity to enter into these Terms. If you use MaxVault for an organization, you represent that you are authorized to bind that organization. A parent or legal guardian is responsible for a minor’s permitted use.

2. License

Subject to these Terms and Apple’s usage rules, Rambax grants you a limited, revocable, non-exclusive, non-transferable license to install and use MaxVault for lawful personal or internal business purposes. The software is licensed, not sold. You may not copy, redistribute, sell, rent, sublicense, reverse engineer, circumvent access controls, or create derivative works except where applicable law expressly permits it.

Apple’s Standard Licensed Application End User License Agreement also applies. If these Terms conflict with a mandatory Apple term or non-waivable consumer law, that mandatory term or law controls.

3. Your Content

You retain ownership of content you place in MaxVault. You grant Rambax only the limited rights needed to process information as described in the MaxVault Privacy Policy and to provide features you request. You are responsible for the legality, accuracy, integrity, and ownership of your content and for obtaining any required permission to capture, import, store, browse, copy, export, or share it.

4. Local Storage, Passcodes, and Backups

MaxVault primarily stores vault content locally. Rambax does not keep a server-side copy of your vault and cannot restore local files merely because you purchased the app or created a recovery account. Deleting MaxVault, a vault or folder, or app data can permanently remove local content. You are solely responsible for data loss resulting from deleting the app, a vault, a folder, or files, or from erasing or replacing a device. Maintain current, independent backups and confirm that an exported or copied file is usable before deleting the original, changing storage settings, or installing major system updates.

You are responsible for remembering and protecting app and folder passcodes. Unless you configured and can access a supported recovery method, a forgotten passcode may be unrecoverable. App passcodes and biometric locks add an application-level access control and do not guarantee encryption, anonymity, secure deletion, or protection from every forensic, operating-system, backup, malware, or physical-access attack.

5. Optional Recovery Account

You must provide accurate recovery information, protect your account credentials, maintain control of the recovery email account, and notify Rambax of suspected unauthorized use. If you request passcode recovery, the requested app or folder passcode is sent to the recovery email address. Anyone with access to that mailbox may be able to read it. Do not reuse a banking, email, device, or other important password as a MaxVault passcode.

Deleting a recovery account does not delete locally stored vault content or cancel an App Store purchase. Rambax may suspend or restrict an account affected by abuse, fraud, compromise, or a legal requirement.

6. Break-In Reports

The optional break-in feature may capture a person’s image and location after an unsuccessful passcode attempt. You are responsible for using this feature lawfully, providing any notice or obtaining any consent required where the device is used, and preventing inappropriate surveillance. Rambax does not guarantee that an image or location will be captured, accurate, admissible, or sufficient to identify a person.

7. Wi-Fi Transfer

Wi-Fi Transfer makes permitted vault content available through a local web service on your device. Use it only on a trusted network, keep the displayed address and access code private, confirm the receiving device, and close the service when finished. Other people on the same network may be able to reach the service if access information is exposed. Network, router, browser, firewall, and device conditions may affect availability, speed, and security.

8. Private Browser and Downloads

MaxVault’s private browser is not a VPN, proxy, antivirus product, content filter, or anonymity service. Websites and network providers can still observe or collect information, set cookies, fingerprint a browser, show harmful or unlawful content, or serve malicious downloads. You are responsible for the sites you visit, content you access or download, and compliance with applicable law and third-party terms. Rambax does not review or endorse third-party websites.

9. Imports, Exports, and External Storage

Imports, exports, local transfers, cloud providers, Apple Files, Photos, email, and share extensions depend on services outside Rambax’s control. Verify that operations completed and that the destination contains a usable copy before deleting an original. Third-party services may retain or process exported content under their own terms.

10. Purchases and Subscriptions

MaxVault may offer one-time purchases or subscriptions. The app displays the applicable price, billing period, renewal terms, and any trial information before purchase.

Purchases are processed by Apple and are subject to Apple’s payment, family-sharing, cancellation, and refund rules. Recurring subscriptions renew unless canceled through Apple before renewal. Rambax cannot directly issue refunds for App Store transactions. Restoring access may require the original Apple Account, an Internet connection, and successful receipt validation.

11. Updates and Availability

We may update, add, remove, suspend, or discontinue features to improve security, reliability, compatibility, or the product. We do not guarantee that every feature will remain available on every device or operating system. You are responsible for installing supported updates and maintaining compatible hardware and software.

12. Prohibited Conduct

You may not use MaxVault or any related Rambax service for any unlawful purpose, to violate the rights of others, or in a manner that is harmful, abusive, exploitative, threatening, harassing, deceptive, or unsafe. This prohibition applies to all content and conduct, including any use that endangers another person or a child or violates child-safety, privacy, intellectual-property, or other civil or criminal laws.

• commit, promote, facilitate, conceal, or support illegal activity of any kind;
• create, possess, store, access, import, export, transmit, or share content prohibited by law;
• use camera, location, browser, download, or break-in features to harm others or for any unlawful purpose;
• probe, disrupt, overload, bypass, or interfere with the app, Rambax services, security, or purchase controls;
• introduce malware or use automated means to abuse Rambax services; or
• misrepresent identity, purchase status, entitlement, account authority, or ownership of content.

13. Privacy

The MaxVault Privacy Policy explains how information is handled and is incorporated into these Terms.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAXVAULT IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION. Rambax does not warrant that MaxVault will prevent every loss, disclosure, intrusion, unauthorized access, malware incident, forgotten passcode, or data corruption. Non-waivable consumer warranties remain unaffected.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RAMBAX AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, VAULT CONTENT, PASSWORDS, OR BACKUPS, ARISING FROM MAXVAULT OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE. RAMBAX’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO MAXVAULT WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID RAMBAX FOR MAXVAULT DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$50.

These limitations do not apply where prohibited by law, including to liability that cannot legally be excluded or limited.

16. Termination

You may stop using MaxVault at any time. We may suspend access to Rambax-operated services if you materially violate these Terms, create a security or legal risk, or abuse the services. Suspending an online account does not give Rambax access to your local vault or create a backup of local content. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limits, and governing law.

17. Changes to These Terms

We may update these Terms to reflect changes in MaxVault, law, or our business. We will post the revised Terms and update the “Last updated” date. If a material change requires additional notice or consent, we will provide it as required by law.

18. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except to the extent the laws of your residence provide mandatory consumer protections that apply. Nothing in these Terms limits rights or remedies you cannot waive under applicable law.
